If your application fulfills all the legal requirements, BIP SXM will enter it into the Sint Maarten register.
Please note that if your trademark cannot be registered after all, (for example: not meeting all the legal requirements) the filing fees will not be refunded. It is therefore required to respond timely and within the periods mentioned in the correspondence with BIP SXM. A trademark expert can help you with this.
You will receive a certificate of registration, and the data of your registration will be registered in the Sint Maarten trademarks register.
As of the registration date, you will be the holder of an exclusive right that you can invoke against others. The filing date however is key to determining which trademark has the oldest right in the event of a conflict.
